It looks like he really took her request to heart, despite her attorney’s plea for leniency. He said he had no choice but to enforce the terms of her plea agreement from this winter, because of her relapse. Her five year sentence was previously stayed on condition that she participate in a drug rehabilitation program. She failed to do that.
Amber was in court to hear the sentencing.
Portwood had been on probation since a drug arrest in December, but was jailed for contempt of court this spring after failing to show up for a drug test. She lied about a medical condition to get out of drug testing, then gave up on rehab and asked to go to prison instead.
The judge said he would refer Amber Portwood to the Indiana Department of Corrections therapeutic community program, which is incarceration-based rehab.
She will be given credit for time served in jail, which is considerable, but nothing like five years. It doesn’t look likely that she will be free before 2016 at least.
